By registering for, accessing, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

Service Description

AI for Headshots is an AI-powered platform that transforms your casual photos into professional headshots suitable for LinkedIn, resumes, business profiles, and personal branding. Our services include:

• AI Headshot Generation: Upload your photos and receive AI-generated professional headshots in various styles
• Multiple Style Options: Choose from business professional, creative, casual, and other headshot styles
• High-Resolution Output: Download high-quality headshots suitable for professional use
• Batch Processing: Generate multiple headshot variations from your uploaded photos
• Free Redo Guarantee: If AI defects occur in your generated headshots, we provide free regeneration

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that may affect your use of the services.

Account Registration and Security

Registration Requirements

• You must be at least 18 years old or the age of majority in your jurisdiction
• You must provide accurate, current, and complete registration information
• You must maintain and promptly update your account information
• Each user may register only one account
• You may not create multiple accounts to obtain additional free credits

Account Security Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized access or security breach
• We are not liable for any loss or damage arising from your failure to protect your account
• You may not share your account with others or allow others to access your account

Payment Terms and Credits System

Pricing and Payment

Our services are provided on a credit-based system. Different features consume different amounts of credits, as specified on our pricing page.

• New users receive a limited number of free credits to try our services
• Free credits are provided only once per user and cannot be obtained through multiple registrations
• Paid credits can be purchased through our secure payment processor, Creem
• All prices are displayed in USD unless otherwise specified
• Prices are subject to change with reasonable notice
• Payment is processed immediately upon purchase
• Credits are non-transferable and non-refundable except as specified in our refund policy

Refund and Satisfaction Guarantee

We stand behind the quality of our AI-generated headshots and offer the following guarantees:

• Free Redo Guarantee: If your generated headshots contain AI defects (such as distorted features, unnatural artifacts, or quality issues), we will regenerate them at no additional cost
• 7-Day Money-Back Guarantee: If you are not satisfied with our service, you may request a refund within 7 days of purchase
• Refunds are processed through the original payment method within 3-7 business days
• Used credits will be deducted proportionally from the refund amount
• Refund requests must be submitted to imxinz@gmail.com with a brief explanation

To request a redo due to AI defects, please contact us at imxinz@gmail.com with the affected headshots. We will review your request and provide regeneration or refund as appropriate.

User Conduct and Acceptable Use

When using our services, you agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Infringe upon intellectual property rights, privacy rights, or other legal rights of others
• Upload photos containing illegal, obscene, violent, discriminatory, or offensive content
• Upload photos of individuals without their consent
• Upload photos of minors (under 18 years old)
• Use automated tools, scripts, bots, or other means to abuse or overload our services
• Attempt to circumvent security measures, access restrictions, or usage limits
• Interfere with or disrupt the normal operation of the platform or servers
• Reverse engineer, decompile, or attempt to extract source code from our services
• Impersonate others or misrepresent your affiliation with any person or entity
• Engage in any activity that could damage the platform's reputation or harm other users
• Use the services for any unlawful or fraudulent purpose
• Resell or redistribute our services without authorization

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

Intellectual Property Rights

Our Intellectual Property

All content, features, and functionality of the AI for Headshots platform, including but not limited to text, graphics, logos, software, interface design, trademarks, and AI models, are owned by us or our licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or software without our express written permission.

Your Uploaded Photos

You retain all intellectual property rights to the photos and materials you upload to our platform. By uploading content, you represent and warrant that:

• You own the content or have the necessary rights and permissions to upload it
• The content does not violate any third-party rights or applicable laws
• You have obtained consent from any individuals depicted in the photos

You grant us a limited, non-exclusive, worldwide license to use, process, and store your uploaded photos solely for the purpose of providing our AI headshot generation services. This license terminates when you delete the photos or close your account, except for backup copies retained for legal or security purposes.

Generated Headshot Ownership

You own the AI-generated headshots created from your uploaded photos. You may use these headshots for any lawful purpose, including commercial use, without attribution to AI for Headshots.

However, you acknowledge that:

• AI-generated headshots are created using our proprietary AI models and technology
• Similar headshots may be generated for other users using similar source photos
• We do not guarantee that generated headshots are unique or free from similarity to other images
• You are responsible for ensuring your use of generated headshots complies with applicable laws
• We are not liable for any claims arising from your use of generated headshots

Service Availability and Disclaimers

Our services are provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding:

• The accuracy, reliability, completeness, or quality of AI-generated headshots
• The availability, uptime, or uninterrupted operation of our services
• The suitability of generated headshots for any particular purpose
• The absence of errors, bugs, or defects in our services
• The security or privacy of data transmission over the internet
• The compatibility of our services with your devices or software

AI-generated headshots are created using machine learning models and may not always produce perfect results. While we strive for high quality, we cannot guarantee that every generated headshot will meet your expectations. This is why we offer our free redo guarantee for AI defects. We do not warrant that our services will be error-free or that defects will be corrected. We reserve the right to modify, suspend, or discontinue services for maintenance, updates, or other reasons.

Limitation of Liability

To the maximum extent permitted by applicable law, AI for Headshots and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Damage to reputation or goodwill
• Cost of substitute services
• Personal injury or property damage
• Any damages arising from your use or inability to use our services
• Any damages arising from unauthorized access to your account or data
• Any damages arising from errors, defects, or AI-generated content quality

In no event shall our total liability to you for all claims arising from or related to these Terms or our services exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless AI for Headshots and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of our services
• Your violation of these Terms or any applicable laws
• Your uploaded content or generated headshots
• Your infringement of any third-party rights
• Any claims by third parties related to your use of our services

Account Termination

We may suspend or terminate your account and access to our services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity
• Non-payment or chargebacks
• Prolonged inactivity
• Legal requirements or government orders
• Our decision to discontinue services

You may also terminate your account at any time through your account settings or by contacting us at imxinz@gmail.com. Upon account termination:

• Your access to services will be immediately revoked
• Unused credits will be forfeited (unless termination is due to our breach)
• Your personal data will be handled according to our Privacy Policy
• Generated headshots may be deleted after a grace period
• Certain provisions of these Terms will survive termination

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

• Email notification to your registered email address
• Prominent notice on our website or platform
• In-app notification when you next log in

The updated Terms will be posted on this page with a new "Last Updated" date and will become effective immediately upon posting. Assignment

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
